By accessing or using Tourio.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including subscribers to our paid services. We reserve the right to update these Terms from time to time. Continued use of the Service after changes constitutes your consent.

2. Service Description

Tourio.ai is an AI-powered social media management platform designed for touring bands, band managers, and promoters. The Service provides:

• Multi-platform video editing and optimization for social media channels (Instagram, TikTok, YouTube, Facebook, X)
• AI-generated platform-specific captions with brand voice customization
• EVER Viral Scoring system (Exclusivity, Emotional Impact, Production Quality, Cultural Relevance)
• Automated viral clip detection from concert and interview footage
• Video transcription using AI speech recognition
• Content calendar with intelligent scheduling
• Tour schedule integration with automated show promotion
• Asset library for stock video, images, and audio management
• Team collaboration with multi-role support

3. Account Registration and Security

To access certain features, you must register for an account. You agree to provide accurate information, maintain password security, notify us of unauthorized use, and accept responsibility for all activities under your account. You must be at least 13 years of age.

4. Subscription and Billing

We offer the following subscription tiers:

• Free Tier: Limited uploads, 2 social channels, basic features with a 3-month trial
• Starter ($99/mo): 100 uploads/month, 4 social channels, AI scheduling
• Pro ($299/mo): Unlimited uploads, all channels, advanced analytics
• Agency ($799/mo): Unlimited everything, multi-band management, white-label

Paid subscriptions are billed on a recurring basis and will automatically renew unless cancelled. You may cancel at any time through your account settings or the Stripe Customer Portal.

5. Payment Processing

All payments are processed securely through Stripe, Inc. We do not store your full payment information. You authorize us to charge all fees incurred by your account. We reserve the right to change pricing with 30 days notice.

6. Acceptable Use

You agree not to use the Service to upload illegal or harmful content, impersonate others, violate laws, infringe intellectual property, distribute malware, reverse engineer the Service, or exceed usage limits through automated means.

7. User Content and Data

You retain ownership of content you upload (videos, images, audio). By using the Service, you grant us a license to process, edit, and transform your content to provide the Service, store it securely, and publish it to third-party social media platforms on your behalf as directed by you.

You are responsible for ensuring you have the rights to all content you upload, including music, performances, and likeness of individuals.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Tourio.ai and are protected by international copyright, trademark, and other intellectual property laws.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. This Service complies with GDPR and CCPA privacy regulations.

10. Termination

We may terminate or suspend your account for breach of these Terms. Upon termination, your right to use the Service ceases immediately. We may delete your account and data after 30 days. You may terminate your account at any time.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE." AI-generated content including captions, viral scores, and scheduling recommendations may contain errors. You should review all content before publishing to social media platforms.

12. Limitation of Liability

Tourio.ai shall not be liable for any indirect, punitive, incidental, special, or consequential damages. Our total liability will not exceed the amount paid by you during the twelve months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Tourio.ai from claims arising from your use of the Service, violation of these Terms, or content published through the Service on your behalf.

14. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States. Disputes will be resolved through binding arbitration on an individual basis.
